Thank author of this post/commentIm am so very upset at the injustice and tyranny of a Pennsylvania District Magistrate. We were unfortunate guests in his court after being sued by an auto complex owner how obtained a judgment for $318 after paying him $3, 400. This Plaintiff was well known to authorities in our area, so you can guess who won the case? Right. So, a constable came to the house to levy the property and placed upon the list property he never saw only assumed we owned, which is illegal in itself. Yes, this judge allowed this illegal levy to stand. Then, we were charged $160 for the sale of the vehicle, which of course we objected to and again, to no avail. BUT we were told that it would be returned once the judgment was paid off. So, we paid the judgment off, went back to this judge to get our $160 and guess what? He refuses to return it. The Magisterial Manager stopped speaking with me once she was told that I had contacted at least 10 magistrates in my area and found this procedure for the collection of judgments was different in most of the cases. One PA law, but magistrates following their own proceedures. Hmmmm? Of course that would create problems for her, so better we get screwed then her do her job. So that avenue was closed. Filed a judicial conduct complalint, but we all know how that is going to turn out, lawyers judging lawyers. And after calling everyone on the freaking planet, its always but this and but that....but no help whatsoever. This judge held this hearing in complete favoritism to the Plaintiff, allowed an illegal levy to stand and now has refused to return our money and there isnt a darn thing I can do about it. I cannot believe the only avenue Pennsylvania residents have regarding forcing this judge to return our money, which is clearly within Pennsylvania law, is a judicial conduct board. How is that possible? I cant sue him, he has immunity. So does anyone out there have any suggestions how to help us. And yes, I have to keep it legal as the other options, no matter how enticing they are, are not an option
